TERMS AND CONDITIONS

  1. MasterPlan Vacations will only book 4 and 5 star level hotels and resorts.

  2. MasterPlan Vacations require a 2 night minimum stay.

  3. MasterPlan Vacations will not be able to give a price breakdown due to our travel partners whom have negotiated contracts with suppliers. This information is proprietary.

  4. MasterPlan Vacations will only use approved travel partners.

  5. MasterPlan Vacations will not be able to book flight OR accommodations using Reward Points.

The purchase of your travel booking constitutes a contractual agreement between the traveler(s), customer(s), and/or purchaser(s) (collectively as “You and Traveler”), and MasterPlan Vacations pursuant to the following terms and conditions.

1. TRAVEL AGENT: MasterPlan Vacations (MPV) acts as a travel agent only. We sell various travel-related product on behalf of numerous transport and accommodation service providers, including, but not limited to, airlines, coach, rail operators, and hotels. MPV does not own, operate, manage, or control these independent suppliers and is not liable for their acts or omissions. MPV’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service  providers.  We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. Requests cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific company, not MPV. Conditions can change rapidly in a country at any time. It is your responsibility to check the USA Government Travel advisories for your intended destination. You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel booking with MasterPlan Vacations.(MPV) You agree to be financially responsible for all of your travel bookings made on behalf of yourself and any member of your traveling party and warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations of purchases with MPV and its suppliers, and acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited. 

2. DEPOSITS, PAYMENTS AND CANCELLATIONS: You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through MasterPlan Vacations. By submitting a credit card authorization form to MPV, you agree to allow MPV to use your payment method to purchase travel products from our Suppliers on your behalf. Prices are subject to increase prior the the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees.  By signing below, you expressly acknowledge your acceptance of these conditions (i.e, increases before full payment and increases attributable to government imposed taxes or fees after full payment will be your responsibility) applicable to your purchase. A non-refundable consulting deposit of USD $250 for single destinations or $450 for multi-stop destinations will be required to start the planning process.  All payments for travel are due proper to departure according to each Supplier’s terms and conditions of  booking. Some airfares or services must be paid in full at the time of booking. You understand that failure to make final payment or any violation of Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in you forfeiting any monies paid for your reservations. Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. You may to be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to MasterPlan Vacations in writing. As a result of cancellation, MPV and third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund. In the case of a NO SHOW by the Client or any traveler(s) in the party, you will forfeit all monies involved, including, without limitation, deposits, all payments on all parts of the itinerary and all commissions paid to MasterPlan Vacations. EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF MASTERPLAN VACATIONS OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF MASTERPLAN VACATIONS OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, MASTERPLAN VACATIONS RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.

3.ELECTRONIC OR HANDWRITTEN SIGNATURE: Both parties agree that you may acknowledge and agree to these Terms: (i) electronically:(ii) by handwritten signature;(iii) by any other electronic means, including, without limitation, via email acceptance of theses Terms; or (iv) by your implied consent deemed via your actions, which shall include, without limitations, the payment of the invoice and /or your use of the services provided by MasterPlan Vacations or any travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgment and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.

4. TRAVEL DOCUMENTS, PASSPORT,  INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS: It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification in order to board a flight. Acceptable identification examples are DHS-designated enhanced driver’s license, Passport or a foreign government passport. The name, date of birth and gender that appears on the identification card MUST EXACTLY match the same data that is listed on an airline ticket (s) and booking records. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing Client to miss flight (s), and subsequent scheduled travel bookings on cruises and tours. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. WHEN YOU RECEIVE ANY AND ALL TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT MASTERPLAN VACATIONS IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. MPV strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-US citizens may require additional documentation. Client is responsible to make MVP aware when traveling on a passport from a country other than the USA. MPV neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel. Should a visa not be issued, MPV is not responsible for lost payments made toward the contemplated trip. Please note that rules of each country regarding entry and exit change on a daily basis. REFUSAL OF SERVICE: Service providers reserve the right to refuse service to travelers at their sole discretion, including, without limitation, if the traveler: (i) lacks proper documentation for the country of destination (ii) has a contagious disease: (iii) is under the influence of alcohol, drugs, or narcotics; and/or (iv) manifests disruptive and /or unruly behavior. MPV assumes no liability for the acts fo the service provider in refusing service.  REAL ID: BEGINNING MAY 2023, IF YOU PLAN TO USE YOUR STATE-ISSUED ID OR LICENSE TO FLY WITHIN THE USA, IT WILL BE YOUR RESPONSIBILITY IT MAKE SURE IT IS REAL ID COMPLIANT.

5. INSECTICIDE NOTICE: Federal Law requires that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time.

6. AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK IN: MasterPlan Vacations shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash ONLY, and may vary in price. Failure to use a full airline reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours proper to scheduled departure time for international flights. We strongly suggest that you reconfirm exact flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Baggage is entirely at owner’s risk.

7. TRAVEL PROTECTION: MasterPlan Vacations offers access to travel insurance to protect passengers and their investment in travel. Unless specifically noted,  travel insurance is not included in the cost of client’s itinerary to protect against third party supplier default/bankruptcy protection, delay, interruption, missed connection for cruises, cancellation, medical emergency transportation/evacuation and repatriation, baggage and personal effects/lost luggage and baggage delay, illness, job loss protection and change of plans, accidental death and disability, travel accident/sickness medical expenses, and more. Proper insurance may protect you from financial loss in almost all circumstances. Without appropriate travel insurance, client understands and agrees that if client cancels or interrupts client’s travel for any reason, portions of the trip/tour may not be refunded and MPV and travel suppliers’ cancellation penalties will apply resulting in the loss of monies up to the full cost of client’s travel booking and related costs. The purchase of travel insurance is not required in order to purchase any other product of service offered by MPV, however if you decline to purchase insurance, MasterPlan Vacations will require your denial of purchase in writing. MPV is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for any travel insurance selected. Any insurance claims that may fall under the relevant travel insurance policy must be submitted by the client to the insurance company identified in the policy. FOR YOUR PROTECTION, WE STRONGLY RECOMMEND THAT YOU PURCHASE TRIP CANCELLATION OR ACCIDENT INSURANCE.

8. HEALTH AND IMMUNIZATIONS: It is your responsibility to ensure you are aware of any health requirements, health advisories, or health travel restrictions applicable to your travel destinations and to ensure that you carry all necessary vaccination documentation.  You must have the proper immunizations and health screenings before travel. MasterPlan Vacations is not responsible the accuracy of health, vaccinations, or documentation proper to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by client’s health practitioner on a valid vaccination certificate, which the client must carry for proof of inoculation. I f you are concerned about taking any medications or inoculation, check with your health care provider BEFORE booking. Check with the Center for Disease Control and Prevention for current information. www.cdc.gov

9. LIMITATIONS OF RESPONSIBILITY AND LIABILITY DISCLOSURE: MasterPlan Vacations (MPV) acts solely as a booking agent for disclosed principal suppliers and is not the source or provider of any travel service. Each supplier is an independent entity with its own management and is not subject to the control of MPV. The Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and you consent to the use of those suppliers. Because MasterPlan Vacations acts as agent for disclosed principal suppliers and does not have the right to control the operations of such independent operator and suppliers, you agree that MasterPlan Vacations is not liable for any personal injury or property damage, which may arise out of these services. MPV hereby disclaims any liability whether based on contract, tort, strict liability, or otherwise, including without limitation liability for any direct, punitive, special consequential, incident or indirect damages in connections with the goods or services provided by any principal supplier booking through MPV, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, willful acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services, their cancellation and refund policies, fuel increases, bankruptcy, or cessation of operations and other matters outside of MasterPlan Vacations control, and you hereby exonerate MasterPlan Vacations from any liability with respect to same. MasterPlan Vacations has solely received commission and fees for travel transactions and client agrees and understands the any recovery from MasterPlan Vacations will be limited to the amount of commission and fees actually received by MPV.

10. FORCE MAJEURE: MasterPlan Vacations will not be in breach of these terms and conditions or otherwise be liable to you for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, illness, disease, animals, acts of war or civil unrest, terrorist acts, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation or any failure of any transportation mechanism to arrive or depart on time.  Natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes or other labor activities, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstances which is beyond the control of MasterPlan Vacations. If due to weather, flight schedules, or other uncontrollable factors you are required to spend additional night (s), you will be responsible for your own hotel, transfers, and meal costs.  THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

11. RISKS/SAFETY: Travel to certain destinations may involve greater risk than others. MasterPlan Vacations urges clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.cdc.gov, www.faa.gov, www.tsa.gov.  MasterPlan Vacations does not represent or warrant that travel touch points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. Client’s participation constitutes acceptance of such events at client’s own risk.

12. RIGHT TO CORRECT ERRORS/OFFERS SUBJECT TO AVAILABILITY: We reserve the right to correct errors. in the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and supplier promotions are subject to availability and may change without notice. Prospective clients are advised to reserve early to avoid disappointment, increases in fares and additional late booking fees.

13. RESERVATION OF RIGHTS: CHANGES TO THESE TERMS: We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms will be provided to Clients and will be effective immediately. 

14.GOVERNING LAW: The construction, validity, and performance of these Terms and Conditions and any disputes between the parties shall be governed by and construed according to the laws of the State of New Jersey, without giving effect to its conflict of law principles, and any federal laws applicable therein. You hereby consent to the exclusive jurisdiction of the courts of the State of New Jersey with respect to any legal proceedings relating to these Terms.  These Terms and Conditions constitute the entire agreement between the Client and MasterPlan Vacations with respect to travel bookings made with MasterPlan Vacations by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and MasterPlan Vacations with respect to communications with MasterPlan Vacations. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
